Introduction
The Judicial Administration and Control Department of the Circosta Law Firm specializes in the management and supervision of companies, assets and estates entrusted to judicial administrators in the context of seizure and confiscation proceedings. We offer technical, legal and managerial expertise to fulfil statutory duties and preserve the value of the assets.
Registration in the Register of Judicial Administrators
Under Article 35 of the Anti-Mafia Code (Legislative Decree 159/2011), as amended by Law No. 161/2017, the judicial administrator must be chosen from among those registered in the National Register of Judicial Administrators.
The legislation sets out criteria of transparency, rotation of appointments, limits on holding multiple appointments and professional requirements commensurate with the complexity of the assets to be managed.
Duties and responsibilities
The judicial administrator is responsible for the custody, preservation and management of seized or confiscated assets pending the judicial proceedings, also with the aim, where possible, of improving their profitability.
The administrator acts under the direction of the delegated judge and must comply with the instructions given, subject to duties of transparency, reporting and diligence in carrying out the mandate.
